1. Scope
These general terms of sale ("Terms") govern the distance sale of the products offered on www.puntamarigin.com ("Site") between Al Spirits ("Seller") and anyone purchasing on the Site ("Customer"). Customers acting for purposes outside their trade or profession ("Consumers") also benefit from the protections of Italian Legislative Decree 206/2005 ("Consumer Code"), which prevail over any conflicting clause. The applicable Terms are those published on the Site when the order is placed.

3. Sale of alcoholic beverages and legal age
Our products contain alcohol. Sales are restricted to persons aged 18 or over (or the minimum legal age in the destination country, if higher). By placing an order the Customer declares to be of legal age. The Seller and the courier may request an identity document on delivery and refuse delivery to minors; in that case the order is cancelled and refunded, less the shipping costs incurred. Please drink responsibly.
4. Products
The main characteristics of each product are described on its product page. Images are for illustration only: as an artisanal product made in small batches, minor differences may occur (for example in the bottle number) that do not affect the product's characteristics.
5. Prices
Prices are shown in euros (or in the currency indicated for the destination country) and include VAT. Prices may vary depending on the selected delivery country. Shipping costs are shown before the order is confirmed. For shipments outside the European Union, any customs duties and charges not shown as included at checkout are paid by the recipient. Displayed discounts comply with art. 17-bis of the Consumer Code.
6. Orders and conclusion of the contract
The contract is concluded when the Customer, having completed checkout, receives the order confirmation email. The Seller may cancel an order if a product is unavailable, in case of an obvious pricing error or if the destination cannot be served, refunding the full amount paid.
7. Payment
Payment is made when the order is placed, using the methods shown at checkout (for example credit and debit cards, PayPal, Shop Pay, Google Pay). Payments are handled by certified providers: the Seller never has access to the Customer's card details.
8. Shipping and delivery
The Seller ships to the countries that can be selected at checkout. Indicative delivery times are 1–4 working days in Italy and 3–12 working days within the European Union; up-to-date costs and times are shown on the Shipping page. In any case, delivery takes place within 30 days of the conclusion of the contract. In the United States we cannot ship to Mississippi, Utah, Vermont and South Dakota: orders to these States are cancelled and refunded. The risk of loss of or damage to the products passes to the Consumer upon delivery. Customers are asked to check the parcel on delivery and to report any damage as soon as possible to orders@puntamarigin.com, ideally with photos.
9. Right of withdrawal
Consumers may withdraw from the contract without giving any reason within 14 days of the day they receive the products, by sending an explicit statement to orders@puntamarigin.com (the form below may also be used). Products must be returned within 14 days of the withdrawal notice, intact and in their original packaging. The direct cost of returning the products is borne by the Consumer.
The Seller will refund all payments received, including standard delivery costs, within 14 days of the day it is informed of the withdrawal, using the same payment method used for the purchase. The refund may be withheld until the products have been received or proof of their dispatch has been supplied. The Consumer is liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature and characteristics.
Under art. 59(e) of the Consumer Code, the right of withdrawal does not apply to bottles whose seal has been opened after delivery, as they are sealed goods unsuitable for return for health protection or hygiene reasons.

10. Legal guarantee of conformity
All products are covered by the legal guarantee of conformity under articles 128 et seq. of the Consumer Code, for defects that become apparent within 2 years of delivery. In the event of a defect, the Consumer is entitled to a replacement or, if this is not possible, to a price reduction or termination of the contract. Defects should be reported to orders@puntamarigin.com, preferably within 2 months of discovery. The costs of enforcing the guarantee are borne by the Seller.
11. Liability
The Seller is not liable for delays or failed deliveries caused by force majeure or events beyond its control. This does not affect any liability that cannot be excluded by law, including liability for wilful misconduct, gross negligence and defective products.

Personal data are processed as described in our Privacy Policy.
13. Governing law and jurisdiction
The contract is governed by Italian law. Consumers resident in another country keep the mandatory protections granted by the law of their country of residence. Disputes with Consumers fall under the jurisdiction of the court of the Consumer's place of residence or domicile; in all other cases the court of Bologna has jurisdiction.
14. Support and complaints
For support or complaints write to orders@puntamarigin.com: we usually reply within 2 working days. Consumers may also use the alternative dispute resolution (ADR) procedures provided for by the Consumer Code.
